Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to use of the Services provided by MiviaLabs LLC ("Mivia"). Capitalized terms not defined here have the meanings given in the Mivia Terms of Use or the applicable agreement with Mivia.

1. Purpose

Mivia provides developer and AI-assisted software services. This AUP is intended to protect users, third parties, the integrity of the Services, and the underlying infrastructure.

You must not use the Services, or permit others to use the Services, in violation of this AUP.

2. Unauthorized Access and Security Abuse

You must not use the Services to:

• gain or attempt to gain unauthorized access to accounts, systems, repositories, networks, applications, devices, credentials, or data;
• bypass or assist in bypassing authentication, authorization, access controls, rate limits, security controls, or other technical restrictions;
• deploy, distribute, or operate malware, ransomware, credential-stealing tools, destructive payloads, or code intended primarily to compromise systems;
• interfere with, disrupt, degrade, overload, or damage the Services or another person's systems;
• conduct denial-of-service attacks;
• scan, probe, or test systems without authorization;
• facilitate unauthorized persistence, exfiltration, credential theft, or evasion of security controls.

Good-faith security research is not prohibited where expressly authorized by the relevant system owner and conducted lawfully. Mivia may provide a separate vulnerability-disclosure policy.

3. Customer Content and Third-Party Rights

You must not submit, connect, process, generate, distribute, or use content through the Services in a manner that:

• infringes or misappropriates intellectual-property rights;
• violates confidentiality, contractual, fiduciary, privacy, or data-protection obligations;
• unlawfully discloses personal data, trade secrets, source code, credentials, or confidential information;
• is fraudulent, deceptive, or impersonates another person or organization without authorization; or
• violates applicable law.

You are responsible for ensuring that you have the necessary rights and permissions to connect repositories, systems, accounts, data sources, and other resources.

4. AI-Assisted and Agent Actions

You must not use Mivia agents, automation, or AI-assisted features to:

• take actions you are not authorized to take;
• execute code or commands against systems without appropriate authorization;
• automatically deploy changes to high-risk or production systems without safeguards appropriate to the risk;
• generate or facilitate malware or other harmful code;
• evade human oversight where such oversight is legally required or reasonably necessary to prevent foreseeable serious harm.

You remain responsible for reviewing and authorizing actions taken using the Services.

5. Illegal or Harmful Conduct

You must not use the Services to facilitate:

• fraud, scams, or identity theft;
• unlawful surveillance or stalking;
• exploitation or abuse of children;
• terrorism or violent extremist activity;
• unlawful discrimination or harassment;
• violations of applicable sanctions, export controls, or trade restrictions; or
• any other unlawful activity.

6. Platform Integrity and Circumvention

You must not:

• circumvent a suspension, termination, access restriction, security control, or usage limit imposed by Mivia;
• create or use another account, organization, identity, connected account, or other access path to evade a valid restriction;
• knowingly provide access to a person or organization whose access has been restricted where doing so would circumvent that restriction;
• interfere with enforcement mechanisms or fraud-prevention systems.

Mivia does not treat a person's nationality, ethnicity, religion, or other protected characteristic as a standalone basis for restriction, except where required by applicable law. A current or former employment relationship, friendship, or similarly weak association with a restricted entity does not by itself establish prohibited circumvention.

7. Restrictions and Enforcement

Mivia may investigate suspected violations and may take proportionate action, including:

• warnings;
• feature or usage limitations;
• removal of content where appropriate;
• temporary suspension;
• organization-level restrictions;
• termination; or
• referral to relevant authorities where required or appropriate.

Where reasonably practicable, Mivia may provide notice and an opportunity to address the issue. Immediate action may be taken where reasonably necessary for security, prevention of harm, legal compliance, or protection of the Services.

8. Reporting Violations

Report suspected violations to [email protected].

Do not include secrets, credentials, or unnecessary personal information in reports.

9. Changes

Mivia may update this AUP. Material changes will take effect as described in the Mivia Terms of Use or applicable agreement.
